By accessing or using ProofPost ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

ProofPost is operated by ProofPost Inc. ("Company," "we," "us," or "our"). These Terms govern your access to and use of our certified mail and proof of delivery service.

2. Service Description

ProofPost provides an automated service for sending USPS Certified Mail with Return Receipt and generating legally-compliant evidence packets. Our service includes:

  • Address verification and validation
  • Document printing and mailing via USPS
  • Real-time tracking and delivery notifications
  • Evidence packet generation with proof of delivery
  • Signature capture and tracking history

3. User Accounts and Registration

To use ProofPost, you must:

  • Be at least 18 years old
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account.

4. Acceptable Use

You agree NOT to use ProofPost to:

  • Send illegal, fraudulent, or harmful content
  • Harass, threaten, or defame any person or entity
  • Violate any laws, regulations, or third-party rights
  • Send spam, unsolicited marketing, or bulk mail
  • Transmit viruses, malware, or harmful code
  • Impersonate any person or entity or misrepresent your affiliation
  • Interfere with or disrupt the Service or its servers
  • Circumvent security measures or attempt unauthorized access

Violation of these terms may result in immediate termination of your account.

5. Pricing and Payment

5.1 Service Tiers

  • Basic Mail: $4.99 per letter + USPS postage
  • Legal Proof: $14.99 per letter (includes certified mail, return receipt, and evidence packet)

5.2 Payment Terms

  • All fees are charged at the time of service
  • Payments are processed securely through Stripe
  • Prices are subject to change with 30 days notice
  • First 5 letters are free for new accounts

5.3 Refund Policy

Refunds are available only if:

  • Your letter was not processed due to our error
  • We were unable to deliver your mail due to our fault
  • You request cancellation before printing begins

No refunds are provided for mail returned by USPS due to incorrect addresses or recipient refusal.

6. Intellectual Property

6.1 Your Content

You retain all rights to the documents you upload. By using ProofPost, you grant us a limited license to:

  • Print and mail your documents
  • Store your documents for proof of delivery purposes
  • Generate evidence packets containing your documents

6.2 Our Content

ProofPost and all related trademarks, logos, and service marks are owned by ProofPost Inc. You may not use our intellectual property without written permission.

7. Service Availability and Limitations

We strive to provide reliable service but do not guarantee:

  • Uninterrupted or error-free operation
  • Specific delivery times (dependent on USPS and other carriers)
  • Successful delivery to all addresses (some locations may be undeliverable)

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

8. Disclaimers and Limitations of Liability

IMPORTANT LEGAL NOTICE

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We disclaim all warranties regarding the Service, including merchantability and fitness for a particular purpose
  • We are not liable for delays, failures, or errors caused by USPS or other third-party providers
  • Our total liability shall not exceed the amount you paid for the specific service that gave rise to the claim
  • We are not liable for indirect, incidental, or consequential damages

9. Indemnification

You agree to indemnify and hold harmless ProofPost, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • The content of documents you submit for mailing

10. Termination

We may terminate or suspend your account immediately, without prior notice, for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment of fees
  • Any reason at our sole discretion

Upon termination, your right to use the Service ceases immediately. You remain responsible for any outstanding fees.

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law provisions.

11.2 Arbitration

Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except for claims that may be brought in small claims court.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by email or through a prominent notice on our website at least 30 days before changes take effect.

Your continued use of ProofPost after changes become effective constitutes acceptance of the updated Terms.

13. Miscellaneous

  • Severability: If any provision is found invalid, the remaining provisions remain in effect
  • No Waiver: Our failure to enforce any right does not constitute a waiver
  • Assignment: You may not assign these Terms without our consent
  • Entire Agreement: These Terms constitute the entire agreement between you and ProofPost
